If you’re a parent in Accomac, Belle Haven, Cape Charles, Chincoteague, Eastville, Exmore, Onancock Tangier Island or Wachapeague, the following news probably won’t surprise you.

A census of pediatricians and family care practitioners in the United States published December 20, 2010, on the Pediatrics website revealed that the United States has more child doctors than it strictly needs. The problem is that an overwhelming number of the doctors and nurses who specialize in taking care of sick babies, toddlers, adolescents and teens practice in and near large cities. This means parents living in rural towns like those on the Eastern Shore of Virginia have few places to take their kids when they get sick or hurt.

My law firm colleague Emily Mapp Brannon wrote last summer about how the general lack of nearby hospitals, clinics and doctors’ office leave Eastern Shore residents with no option but to drive long distances — often north into Maryland (MD) or south into Virginia Beach or Norfolk — to receive medical care. Even the lone hospital, Shore Memorial Hospital in Nassawadox, can be too far away to ensure that drivers and passengers injured in car or truck accidents receive lifesaving care in a timely manner.

Pediatricians play essential roles in keeping kids healthy and parents sane. Having ready access to a health care provider specifically trained to recognize the difference between simple illnesses and serious diseases in youngsters, someone who knows how to prescribe and dose medications for little ones, and a doctor or nurse who can gently work with often scared and confused children can be priceless. While pediatricians and family medicine practitioners sometimes make mistakes, they are still the best health resources for kids and the adults who care for them.

The authors of the Pediatrics article called for steering kids’ health care providers to rural areas by using a mix of financial incentives and professional perks. That sounds like a good plan to me. If such efforts succeed and fewer children on the Eastern Shore go without proper diagnoses and treatments because of simple lack of access to doctors and nurse, then everyone will benefit.

As many as 600 Virginia (VA) and Maryland (MD) being treated for the somewhat controversial condition dubbed chronic Lyme disease are poised to lose their primary caregiver. Members of the Virginia Board of Medicine voted on September 16, 2010, to suspend the narcotic prescribing privileges of Belle Haven family physician Dr. Geoffrey Gubb. According to a report in the Virginian-Pilot, medical board members acted after determining that Gubb had overprescribed powerful painkillers and antibiotics for an infectious disease many members of the medical profession do not believe exists. Gubb, who is 73 years old, has decided to surrender his license altogether and shutter his practice rather than contest the suspension.

Not being a doctor, entomologist or epidemiologist, I can’t say that either Dr. Gubb or the medical board are correct in how or whether patients should be treated for the possible persistence of a tick-borne disease like Lyme disease. As a lawyer who has spent more than 20 years representing both patients and health care providers like doctors and nurses in medical malpractice cases, however, I find many aspects of Gubb’s and his patients’ situation interesting.

For instance, if patients have been receiving too many narcotic painkillers known as opiates and opioids, those people have been inappropriately put at risk for injuries or even loss of life from overdoses. Similarly, if patients had other treatable illnesses that got misdiagnosed as chronic Lyme disease, they may have suffered years of pain and disability they could have avoided. And, then, on the other hand, if Gubb has indeed been doing right by his patients, he and they may have grounds for lodging complaints against the medical board for unjustly denying access to needed health care.

Since the one of the key purposes of the medical malpractice civil justice system is to create economic penalties for incompetent doctors — and the magnitude of malpractice actions and verdicts can serve to weed out subpar physicians — such issues need to be considered.  Likewise, when the Board of Medicine acts against a doctor it also has the effect of policing the medical ranks, but the board may sometimes act without full justification.

Whatever the reality may be, I hope all the patients Gubb treated find the care and relief they need.

The pony swim began in 1924. Children’s author Marguerite Henry made the annual event famous when she published Misty of Chincoteague in 1947. For the past several years, an estimated 40,000 adults and children of all ages have crowded the western shore of Chincoteague Island to watch the wild ponies swim the few hundred feet from Assateague Island. The year-round population of Chincoteague is just over 4,000.

With a majority of Chincoteague residents employed in the tourism and food service industries, the pony swim is essential to the island’s economy and, no doubt, the economies of the nearby Accomack County communities of Atlantic, Horntown, Sinnickson, Wattsville and Wallops Island. An influx of tourists that increases Chincoteague’s population tenfold also strains the resources of the entire Eastern Shore, particularly Route 13 and Route 175.

Fortunately, traffic appears to become merely snarled at pony swim time. A detailed breakdown of fatal car and truck accidents on Chincoteague Island since 1979 shows that no drivers or passengers lost their lives on the island’s roads during the last week of July. Ironically, however, Paul Beebe, who’s real-life childhood adventures are chronicled in Misty, died in an automobile accident in 1957.

A truly impressive feat of engineering and a drive unequalled in beauty on clear, warm spring days like the one on which I’m posting this, the Chesapeake Bay-Bridge-Tunnel has carried more than 100 million cars and trucks between Northampton Boulevard in Virginia Beach, Virginia (VA), and Route 13 on Virginia’s Eastern Shore since opening to traffic in 1964.

Expanded from two lanes – one north and one south on the same road bed – to two lanes on separate spans in both directions in 1999, the CCBT cuts nearly 100 miles and more than two hours off the driving time between the Eastern Shore and Hampton Roads. The Bridge-Tunnel has been a boon to commercial traffic, commuters and tourists. It has also seen its share of accidents resulting in serious injuries and loss of life.

Tunnels and bridges present unique risks to drivers, from narrow lanes to extreme changes in visibility and lighting due to fog, mist and driving into and out of tunnel entrances and exits. Car and truck accidents are practically daily occurrences on the Hampton Roads Bridge Tunnel between Norfolk and Hampton, for instance. While rarer, accidents on the Chesapeake Bay Bridge-Tunnel have often been severe.

A tractor-trailer drove off the CCBT in March 2005 and died when his rig hit and sank in the Bay. An SUV driver lost his life the same way on New Year’s Eve in 2006, and another tractor-trailer driver required hospital treatment for a knee injury he suffered when he clipped a parked maintenance truck on the Chesapeake Bay Bridge-Tunnel.

One way bridge operators prevent car and truck accidents is closing the Bridge-Tunnel to certain vehicles when high winds, heavy rains or snow hit the Bay. The CCBT also shuts down and receives a thorough structural inspection when ships or barges – inevitably – strike one of the bridge supports. Bridge employees are even available to drive people’s cars and trucks across the CCBT “whenever a customer has a phobia of heights, bridges, tunnels, etc.”

No policies or practices can take the place of safe driving, though. Be careful the next time you make the tip from Virginia Beach to Kiptopeke and points north in Accomack and Northampton and Accomack counties.

The U.S. Census Bureau counted 51,398 residents of the Virginia (VA) Eastern Shore counties of Accomack and Northampton in 2000. A July 2008 estimate put the number of people living on the Eastern Shore at 51,595. So the population hasn’t grown much over the past decade. The number of hospitals and clinics serving the Eastern Shore hasn’t grown at all.

A single hospital and a single clinic system with six satellite offices serve the entire population and 662 square miles of the Eastern Shore. Riverside Shore Memorial Hospital in Nassawadox holds a license for 143 beds, 14 of which can be reserved for in-patient mental health care. The main facility offers emergency, surgical, orthopedic, cancer, cardiovascular and pulmonary care. Riverside also operates Shore LifeCare in Parksley for patients who are too sick or injured to live at home, as well a family care and general medical practice named the Shore Medical Center at Metompkin.

Adults and children living on the Eastern Shore also have access to more routine outpatient and dental care through the clinics operated by the Eastern Shore Rural Health System in Cheriton, Chincoteague, Franktown, Nassawadox, Oakhall and Onley.

Nassawadox sits in pretty much right in the middle of Virginia’s Eastern Shore, placing its hospital’s emergency room as much as 35 miles from car accident victims in Cape Charles in the south and New Church and Sinnickson in the north. In addition to Riverside Shore Memorial’s geographic inaccessibility for many people, an article published in Virginian-Pilot in February 2009 paints a picture of a hospital badly in need of major repairs, technological upgrades and infusions of cash and doctors, nurses and other medical personnel in order to better care for patients.

Doubtless, many Eastern Shore residents travel north into Maryland (MD) or south into Virginia Beach and Norfolk, Virginia (VA) when they need medical care. This may be good for the bottom line of health care systems like Sentara, Bon Secours and the McCready Foundation of Crisfield, Maryland (MD). It is, at a minimum, a huge inconvenience for people who are sick or injured. At worst, lack of easy access to quality and necessary medical care can result in chronic poor health and even death.

Another possible negative outcome from having few choices for where to get care and of whom to get care from is that patients may be treated poorly. Where there are few doctors, there is also a dearth of broad experience, specific expertise and recourse to second opinions or alternative treatments. This could lead to an unnecessary loss of life if someone who is seriously injured doesn’t receive adequate care.

Winter weather has finally receded and spring is upon us. With the change of the seasons comes an influx of boaters on the Eastern Shore ready to enjoy a beautiful day on the water. However, just because you’re out on a boat doesn’t mean basic safety precautions can be ignored.

Unfortunately, many people do the exact opposite and throw caution to the wind, which could help explain the 681 deaths, over 4,000 injuries and $31 million in property damage from boating-related accidents, according to easternshore.com.

Close to 80 percent of lives lost in boating accidents featured an operator who did not complete a boating safety education course and roughly 70 percent of all boating wrecks and injuries involved “operator-controlled” factors such as reckless operation, inexperience, and speeding.

Even more disturbing is the fact that alcohol played a role in more than one third of all boating deaths.

I understand the inclination to enjoy an adult beverage while out with friends and family on a boat. However, if you’re the operator, you need to exercise due diligence and appreciate the fact that you are responsible for the lives on your boat. Getting drunk or even slightly “buzzed” is reckless and could prevent you from reacting properly to an accident or injury. If the Coast Guard is called to assist, you could be charged with a BUI (boating while under the influence).

The Coast Guard, and every state, has stringent penalties for violators of BUI laws. Penalties can include large fines, suspension or revocation of boat operator privileges, and jail terms. The Coast Guard and the states work in tandem to remove intoxicated boaters from the waters, according to the Boating Safety Resource Center.

In Virginia (VA), the law states that boat operators with blood alcohol concentrations of 0.08 percent or more by weight, by volume, shall be presumed to be under the influence of alcohol intoxicants, according to boatus.org. Virginia law also prohibits persons under the age of 21 from consuming alcohol and operating a boat with any measurable alcohol level (established at 0.02 percent by weight by volume). This is referred to as zero tolerance. If these laws are violated, the penalty usually includes fines and jail time.

Getting charged with a BUI, or suffering a major boating accident, can certainly ruin your day on the water with friends and family. This is why following basic safety principles like wearing your life jacket, yielding to canoes and rowboats, not speeding, and not drinking excessively, will help ensure you have a good time on the Eastern Shore waters.

A 17-year-old girl was killed in a car crash on the Eastern Shore town of Accomack back in early March. She was driving on Upshurs Neck Road near Quinby Bridge Road when her 2005 Pontiac G6 suddenly veered off the road and hit a tree. Unfortunately, the teen apparently wasn’t wearing her seatbelt and was ejected from the car, according to delmarvanow.com. 

This is a terrible loss and my heart goes out to the parents of this young girl. Dealing with the loss of life of a loved one is never easy, but it has to be especially challenging when it’s someone so young who has their whole life ahead of them.

Hearing about these types of car accident deaths is so frustrating because there’s a chance this girl, and others like her, could have survived if they had worn their seat belt. Many people consider seat belts to be the most effective safety device in car today.

Reports indicate they save an estimated 9,500 lives each year, according to the National Highway Transportation Safety Administration. However, only 68 percent of drivers wear their seat belt. This needs to change. We have to get this percentage up. There are reports that suggest if 90 percent of drivers wore their seat belt, over 5,500 lives would be saved and 132,000 injuries could be avoided. There’s simply no excuse not to wear a seat belt.

Angel Antonio Guiterrez of Belle Haven was driving his 1996 Honda Accord south on Lankford Highway when he ran off the road to the right, struck a ditch bank and overturned several times. He died as a result of the accident. This is the second loss of life from a car wreck in 2010 in the Eastern Shore area, according to the Eastern Shore Post.

In 2008, there were 3,927 car wrecks that occurred as a result of cars running off the road, according to the Virginia DMV. In fact, cars that ran off the road constituted 38 percent of all car wrecks in the Commonwealth (the second highest percentage for all car accident causes). 

Sgt. Michelle Cotten of the Virginia State Police said Mr. Guiterrez was less than a mile from Route 620 in Painter when the car accident occurred. We still don’t know what exactly caused his Accord to veer off the road. Was it a mechanical error? Was he trying to avoid something in the road? These questions remain unanswered. Police continue to investigate the accident.

Counties in the Eastern Shore including Accomack and Northampton do not boast large populations, but their accident statistics are incredibly high. In face, both counties feature a fatality rate per 100,000 individuals that is higher than the national average, according to the National Highway Safety Administration. The primary reason is one stretch of road: Route 13.

The lack of adequate medians and increased truck traffic make Route 13 a very dangerous highway. This is a volatile situation considering a large number of  Virginia (VA) Eastern Shore cities and towns are located along Route 13. 

Jim McGowan, the Accomack County planning director stressed the importance of median reform. He said many medians don’t have any turn lanes or the lane is too short to handle more than one vehicle when a turn is made, according to Delmarvanow.com. In addition, the medians are usually too narrow, so it allows vehicles to cross through the median and into the other lane of traffic along with many median crossovers being too close together.

The Route 13/Wallops Island Access Management Study recommended expanding median widths to at least 50 feet while closing roughly 70 median crossovers, adding rumble strips to road shoulders and reducing access points to Route 13 (there are currently 1,300).

Unfortunately, these suggestions have largely been ignored by county officials. The reason being money. The cost of implementing all the proposed reforms would cost over $100 million. It’s really disappointing to hear that budget concerns are superceding the safety of drivers and Eastern Shore residents. Many stretches of highway are dangerous, but few have actual studies highlighting the inherent dangers.

The representatives of both counties need to ask themselves, “What’s worse - spending money to renovate a dangerous highway and potentially decreasing the number or car wrecks or having this same highway featured on the news and in studies as a potentially deadly stretch of road?”

“People complain about it,” said McGowan. “There are a lot of accidents, a lot of [fatalities] on Route 13.” The evidence is clear and the transportation officials in Accomack and Northampton counties need to take action.
